Planning Permission Secured for Dual Gym and Night Club Use

Our planning consultants submitted a planning application to Eastbourne Borough Council that sought the introduction of a gym use alongside the existing Sui Generis night club use. We are pleased that Eastbourne Borough Council subsequently granted planning permission for this proposal.

The Planning Challenge

The existing property had extant planning approval for a night club use, however our client had demand for this space from a gym and personal trainer operator. Our client didn’t want to lose the existing consent so we advised applying for a dual planning use under Class V of the General Permitted Development Order. This would allow the gym use and the night club use to be used interchangeably for a period of 10-years.

We had to demonstrate to the Council that both uses were acceptable in principle, being located within Eastbourne Town Centre and that there were no technical constraints that would prevent either of these uses from being carried out or would affect the amenity and function of the neighbouring buildings.

This dual planning permission has given our client flexibility and broadened the planning scope of this building for the foreseeable future.

The permission has also introduced a gym and leisure use in a highly sustainable location for the benefit for the wider population.
