Consent For 4 Dwellings Outside The Settlement Boundary At Mistley, Essex
ADP have secured full planning consent for 4x detached dwellings at the village of Mistley, Essex, within Tendring District.
The site is located outside of the settlement boundary of Mistley and was therefore deemed to be open countryside for local planning policy purposes. The site however, was not isolated, being located between an existing area of development and the edge of the built-up area of Mistley.
A D P were able to demonstrate that Tendring District Council could not maintain a 5-year housing land supply and consequently the ‘Presumption in Favour of Sustainable Development’ in the National Planning Policy Framework took precedence. ADP were also able to demonstrate to Tendring District Council that the development proposed, in terms of its location, scale and design, could seamlessly be incorporated into its surroundings and would constitute a logical infill that would relate well to the existing village settlement boundary.
Planning success in this instance was gained by having a high-quality design-led scheme, professional advice and early engagement with the Council. This approach ensured that the planning application was approved and avoided the need for an unnecessary appeal.
