Permission in Principle Approved in Tendring

We have recently secured a ‘permission in principle’ for a single dwelling on land at Great Bentley, Essex and within Tendring District.

The site is currently used for industrial storage and as a workshop, but is located outside of a settlement boundary, where there is normally a general presumption against development. We were able to demonstrate that Tendring District Council currently does not have a 5-year land supply and that their local plan policies were out of date. We also pointed out that the application site is located in an area that is proposed to be included in village settlement boundary in the emerging Tendring District Local Plan 2013 – 2033 and given the advanced stage of the plan production, carried significant weight.

The Tendring District Local Plan 2013 – 2033 has been submitted to the Planning Inspectorate for examination. Section 1 of the Local Plan, which addresses strategic spatial growth across North Essex, was submitted jointly with Braintree District Council and Colchester Borough Council. However, this initial stage was been delayed as the Planning Inspector seeks further clarification and evidence to inform the spatial strategy. This has caused a delay in the consideration of Section 2 of the Local Plan, which considers more localised planning policies and site allocations, specific to Tendring.

Until the new local plan has been found sound by the Planning Inspector and adopted by Tendring District Council, there will be a planning policy vacuum that provides an opportunity to secure a favourable planning consent for sites that fulfil the role of sustainable development but are within locations not normally supported by planning policy.

There are a variety of planning application routes available, for example, permission in principle, outline planning, and full planning. Each potentially has merits depending on the characteristics of what is being proposed and the site context.
